By engaging our services or using our website, you agree to the following professional terms and conditions.

1. Scope of Service

We provide professional surveying and consultancy services specifically for Regularisation Applications. Our role is to act as your advocate to demonstrate compliance to Local Authority Building Control.

Please note that Regularisation Applications only apply to unauthorised works carried out on or after 11 November 1985. Works completed before this date cannot be processed under this legal pathway.

2. Professional Status

This is a Chartered RICS Practice. All advice and surveying work are carried out under the professional standards and ethical guidelines of the Royal Institution of Chartered Surveyors.

3. Fees and Statutory Charges

3.1 Statutory Application Fee: A one-off fee is payable at the point of application submission. This charge represents the statutory fee required by the Local Building Authority for the legal deposit and processing of a Regularisation Application.

3.2 VAT Treatment: In accordance with UK tax legislation regarding statutory regulatory services provided by local government bodies, VAT is not payable on the building authority application fee.

3.3 Non-Refundability: Once the application has been deposited with the local authority, the application fee is strictly non-refundable, as it covers the authority's immediate administrative and historical plan-checking costs.

3.4 Professional Consultancy Fees: Any fees for professional surveying, advocacy, or consultancy services provided by this practice are distinct from the statutory application fee. These will be clearly itemized in your bespoke fee quote.

4. Inspections and Opening Up

A satisfactory outcome requires a physical on-site inspection. In accordance with building regulations, certain areas of the property may need to be "opened up" (e.g., exposing foundations or structural members) to verify compliance. The cost of any remedial works or opening up is the responsibility of the property owner.

5. Limitation of Liability

While we use our "insider" expertise as former building control surveyors to provide the best possible roadmap to compliance, the final decision to issue a Regularisation Certificate rests solely with the relevant Local Authority Building Control department.

6. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales.
